The BPA has announced an amendment to its rules for telemarketing calls. Here’s an update to what you need to know:
- All calls must still be recorded
- A boss can make a direct request for an employee
- An assistant can still make a direct request
- The assistant no longer needs to verify that they provide administrative support and are therefore authorized to make a request on behalf of the targeted subscriber.
- If the subscriber, their boss or their assistant is unable to be reached, anyone else in the company providing consent qualifies as a company request.

For example – If your circulation has a great number of subscribers who are hard to reach, and the percentage of time our reps end up having to talk to a “qualified other” (now known as an assistant or supervisor), then you can expect a different impact compared to a publishers with subscribers that are available 85% of the time we call (where we less frequently have to talk to a qualified other).
That rule will have a different impact on the publisher using a long script with many demographic questions (i.e. long purchasing authority) or with a lead generation element in the script where talking to the “label person” is mandatory.
